PAYMENT TERMS:
- Payment is due within one hour after the sale is
complete. If you entend to purchase more than
one item please allow us to know so that we will not run
your credit card before your final purchase.
- Payment must be approved prior to dale by barn
management.
- There will be a 5% charge on all website
purchases.
- ALL GUARANTEES ARE BETWEEN THE BUYER AND THE
SELLER AND DO NOT CONCERN THE ELKHART HORSE CENTER L.L.C. OR THE
AUCTIONEER AND THE BUYER UNDERSTANDS AND AGREES THAT THE ELKHART
HORSE CENTER L.L.C. IS NOT RESPONSIBLE FOR ANY SUCH
GUARANTEES.
- All sales are FINAL and the buyer purchases on a
"AS IS" basis and is responsible for the removel of their
purchases. Storage fee for property left over 16 hours is
$10.00 per day.
- The commission is applicable to all sales
resulting from exposure through registration with the Elkhart Horse
Center L.L.C. whether made in the actual auction or after.
- Elkharat Horse Center L.L.C. is not responsible
for injuries or damage to person or property. The buyer
agrees to release the Elkhart Horse Center L.L.C. from liability
and to forbear any and all claims for injury, damage or loss to
person or property in exchange for the use of the barn and benfit
participation in the sale.
- Under Texas law (chapter 87), Civil Practice and
Remedies Code, an equine professional is not liable for an injury
or the death of a participant in equine activities resulting from
the inhereent risks if equine activities.
- The buyer fully acknowledges that any property
(horses,tack, and/or property consigned to the Elkhart Horse Center
L.L.C.) removed from said property will be paid in full by debit or
credit card. Any insufficient funds, no funds on the drawer
or maker has no account or the account on which it is drawn or
charged has been closed, waive recognition of such payment and
accept full responsibility of theft (felony or misdemeanor charges)
of livestock, tack, or other property.
- Should it become necessary to enforce payment
against you for any reason it is hereby agreed that the buyer will
be responsible for attorney's fees and legal expenses that are
reasonable and allowed by law.
- NO PRE-RING SALES AND NO ALLEY TRADING!
BARN RECEIVES A COMMISSION ON ALL SALES ANYWHERE ON THE ELKHART
HORSES CENTER L.L.C. PROPERTY.
